New Year, New Laws

As always, with the new year comes new laws. These laws kicked in as of January 1, 2024. Get familiar with them. Of course, we can help navigate all the laws of the trade.

SB 630 (Dodd)
This bill requires CSLB licensees and applicants to provide an email address, if available, when they obtain and renew licenses. The email addresses are not subject to disclosure under the California Public Records Act. This bill also authorizes the Registrar to automatically reimpose license revocation when probationary conditions placed on a license are not met. (Chapter 153, Statutes of 2023)

AB 336 (Cervantes)
This bill requires licensees with a workers’ compensation policy to provide the top three workers’ compensation classification codes on their workers’ compensation policy when they renew their licenses. Those codes will be posted on the CSLB license lookup webpage. Licenses won’t be renewed without the codes. However, the bill allows for retroactive renewal if the licensee provides the codes within 30 days after receiving notice of the denial. (Chapter 323, Statutes of 2023)

AB 1204 (Holden)
This bill prohibits specialty contractors from subcontracting with two or more contractors in the same classification on the same jobsite unless the subcontractor has employees who perform the work in the relevant classification or are party to a collective bargaining agreement. This bill makes violations of this section cause for disciplinary action. (Chapter 568, Statutes of 2023)

SB 601 (McGuire)
This bill increases the statute of limitations to three years for misdemeanor violations by a licensed contractor for allowing an unlicensed person to use their contractor license. This bill also requires courts to assess the maximum civil penalty for specified home improvement contract violations in declared disaster areas. (Chapter 403, Statutes of 2023)

‘The era of saying ‘no’ to housing is coming to an end’: New California building laws for 2024

If California wants to build its way out of its long term housing shortage, plenty of things stand in its way in 2024: high interest rates, sluggish local approval processes and a persistent shortage of skilled construction workers, among others.

But a slew of housing bills from the 2023 legislative session went into effect on Jan. 1, promising to ease or eliminate some of the other burdens.

In short, California is removing some barriers and boosting incentives for housing construction.

CSLB Works with NASCLA to Help Get a Veteran Back into a Home

SACRAMENTO, CA – The Contractors State License Board (CSLB) worked with the National Association of State Contractors Licensing Agencies (NASCLA) and Rebuilding Together Sacramento on providing essential home repairs for a deserving elderly veteran Tuesday, December 5.

This was part of NASCLA’s third Annual Mission, which focused on providing essential home repairs for a deserving U.S. veteran in Sacramento. Following his spouse’s passing, the veteran who is in his early 80s faced challenges in maintaining his residence. This led to an unsafe living environment causing the homeowner to be displaced. NASCLA partnered with Rebuilding Together Sacramento, who stepped in to assist with the restoration of the home to ensure the veteran’s safe return to a comfortable living environment.

NASCLA made a $10,000 contribution to the project in addition to providing a team of 15 volunteers who spent the day providing services to rehabilitate the home. NASCLA’s commitment goes beyond licensing agencies and extends to the residential and building communities we serve.

“NASCLA is proud of the impactful work we’re doing for our third Annual Mission with Rebuilding Together Sacramento, focusing on a veteran’s home. It’s more than construction; it’s about restoring dignity, rebuilding dreams, and honoring those who’ve served. Together, we’re not just renovating houses; we’re making a lasting difference in lives,” said David Fogt, NASCLA President and Registrar of the Contractors State License Board, and Angie Whitaker, NASCLA Executive Director.

NASCLA promotes best practices and license uniformity for agencies that regulate the construction industry. Comprising state licensing boards and agencies across the United States, NASCLA works to establish and maintain high standards for contractor licensing and regulation, fostering public safety and consumer protection.

Rebuilding Together Sacramento, a nonprofit organization dedicated to repairing homes, revitalizing communities, and rebuilding lives, played a crucial role in coordinating and executing the project.

“Volunteers serve as the backbone of Rebuilding Together Sacramento; they enable us to help more homeowners and families in need every year,” said Trysh O’Connor, Rebuild Program Manager. “Their dedication and volunteer time make it possible for us to offer our services free of charge, allowing us to make an impact on the lives of those facing challenges within their own homes. Through their selfless contributions, our volunteers not only repair homes but also rebuild communities.”

As a result of NASCLA’s third Annual Mission, this veteran will be able to return to a safe and secure home. Images from the project can be seen below.

Here’s to Our Contractors & RMOs

During this time of giving thanks, we would like to take the this time to thank all of our contractors and RMOs. We love what we do and we want to thank you for giving us the opportunity to serve you. We love knowing that what we do helps build careers and livelihoods and we do not take that lightly. 

We would also like to reflect on the fact that not only are we helping build careers, but the people we help, pay it forward. From the RMO sharing their knowledge with the new generation of tradesmen to the licensed contractor building homes and workplaces for our communities, we know what we do with you ripples out and makes a positive difference in this world.

Again, we love what we do, we love to see knowledge passed down, companies succeed, communities built, but all this starts with you and we would like to thank you. It’s one of those things, where maybe it’s not said often enough, but it’s always in our minds and reflected in our work.

So again, from everyone on our team, thank you.

Thankful For The Tradesmen

Construction professionals build the world around us and we would like to show appreciation and give thanks to all the tradesmen out there. They create everything from our homes and office buildings to shopping malls and roadways, they construct and maintain our access to running water and electricity, and renovate our homes and sometimes it’s easy to take it all for granted.

Even though their amazing, skilled work surrounds us every single day, too often we barely even notice it is there. While we interact with the fruits of construction every day, we rarely take the time to consider the skills and knowledge that went into it.

These skilled craft professionals work behind the scenes, quietly and generally without credit, they are constructing our world. Too often they are overlooked and underappreciated. It’s time to take a moment, appreciate, and give thanks for what they do for everyone. Without the tradesmen of the construction field, where would our community be?

History of Veterans Day

World War I – known at the time as “The Great War” – officially ended when the Treaty of Versailles was signed on June 28, 1919, in the Palace of Versailles outside the town of Versailles, France. However, fighting ceased seven months earlier when an armistice, or temporary cessation of hostilities, between the Allied nations and Germany went into effect on the eleventh hour of the eleventh day of the eleventh month. For that reason, November 11, 1918, is generally regarded as the end of “the war to end all wars.”

Veterans Day continues to be observed on November 11, regardless of what day of the week on which it falls. The restoration of the observance of Veterans Day to November 11 not only preserves the historical significance of the date, but helps focus attention on the important purpose of Veterans Day: A celebration to honor America’s veterans for their patriotism, love of country, and willingness to serve and sacrifice for the common good.

In this edition of RMO World, we wanted to take a little time to share our wonderful team with you.

Our team of professionals is dedicated to your success in a way that no other agency can even offer. Not only does our team know the construction industry, but we are also driven to see you succeed!

RMO Agency has been doing this since 2006 and we have grown immensely over the years both with our knowledge and the resources we provide to you. We have adapted to the times and changed to address the needs of the construction community. We have spent many years building this agency and are proud of our accomplishments today and the success stories we helped create!

We are not just a group of people who happen to work at the same company. We are a team and a community. Our foundation principle is building relationships and that starts from the ground up with us. Governor Signs Contractor Bill

Gov. Gavin Newsom signed into law bill SB630, legislation from state Sen. Bill Dodd, D-Napa, that would boost consumer protection by improving oversight and training of California’s nearly 300,000 licensed contractors.

“Ensuring contractors work in a safe, competent, and professional manner is at the heart of our commitment to Californians,” Sen. Dodd said. “A way to do that is through better communication and education, as well as clear pathways for improvement when things go wrong. This new law will advance these principles among the licensed trades to strengthen an industry that is essential as we continue to build out our state.”

The California Contractors State License Board regulates 44 types of contractors including builders, plumbers, electricians and painters. To ensure compliance with performance and safety standards, the board can impose remedial training or payment of restitution to consumers. However, completion of these requirements does not always happen in a timely manner. Sen. Dodd’s proposal, Sen. Bill 630, would streamline this probationary process, ensuring contractors meet licensing obligations with fewer delays.

Additionally, SB 630 would help CSLB save money currently spent on mailing contractors tens of thousands of educational bulletins and documents by requiring submission of an email address with license applications so that communications can be sent electronically.

Ancient Architecture

The Roman Colosseum is one of the most famous and iconic buildings in human history, let’s take a look at some of the facts of this amazing structure.

At 620 feet long and 513 feet wide, the Colosseum in Rome was easily the largest amphitheater around when it was in its prime. Like other large structures of the time, the Colosseum was not built into the side of a hill instead, it was a fully freestanding stadium with a foundation of concrete and stone that could provide seating for 50,000 visitors in multiple seating configurations and levels. On top of that, the Colosseum’s 80 awning-covered arches lead visitors into an arena that was so well-engineered that it could even be flooded with water to support aquatic events.

It is the largest ancient amphitheatre ever built, and is still the largest standing amphitheatre in the world, despite its age. Construction began under the emperor Vespasian in 72 AD and was completed in 80 AD under his successor and heir, Titus. Further modifications were made during the reign of Domitian. The three emperors who were patrons of the work are known as the Flavian dynasty, and the amphitheatre was named the Flavian Amphitheatre

The name Colosseum is believed to be derived from a colossal statue of Nero on the model of the Colossus of Rhodes. The giant bronze sculpture of Nero as a solar deity was moved to its position beside the amphitheatre by the emperor Hadrian (r. 117–138). The word colosseum is a neuter Latin noun formed from the adjective colosseus, meaning “gigantic” or “colossean”. By the year 1000 the Latin name “Colosseum” had been coined to refer to the amphitheatre from the nearby “Colossus Solis”.

A Brief History of Labor Day

  • The first Labor Day parade took place in New York City in 1882.
  • Labor Day was declared a national holiday in 1894 and is observed on the first Monday in September.
  • The roots of Labor Day grew out of violent clashes between labor and police during the Haymarket Riot in 1886, when thousands of workers in Chicago took to the streets to demand an eight-hour workday.
  • Today, Labor Day weekend marks the unofficial end of summer, but worker-oriented Labor Day parades and festivities are still part of the federal holiday.

Labor Day, an annual celebration of workers and their achievements, originated during one of American labor history’s most dismal chapters.

In the late 1800s, at the height of the Industrial Revolution in the United States, the average American worked 12-hour days and seven-day weeks in order to eke out a basic living. Despite restrictions in some states, children as young as 5 or 6 toiled in mills, factories and mines across the country, earning a fraction of their adult counterparts’ wages.

Workers began organizing strikes and rallies to protest poor conditions and compel employers to renegotiate hours and pay.

Many of these events turned violent during this period, including the infamous Haymarket Riot of 1886, in which several Chicago policemen and workers were killed. Others gave rise to longstanding traditions: On September 5, 1882, 10,000 workers took unpaid time off to march from City Hall to Union Square in New York City, holding the first Labor Day parade in U.S. history.

The idea of a “workingmen’s holiday,” celebrated on the first Monday in September, caught on in other industrial centers across the country, and many states passed legislation recognizing it. Congress would not legalize the holiday until 12 years later, when a watershed moment in American labor history brought workers’ rights squarely into the public’s view.

In the wake of this massive unrest and in an attempt to repair ties with American workers, Congress passed an act making Labor Day a legal holiday in the District of Columbia and the territories. On June 28, 1894, President Grover Cleveland signed it into law. More than a century later, the true founder of Labor Day has yet to be identified.

Many credit Peter J. McGuire, cofounder of the American Federation of Labor, while others have suggested that Matthew Maguire, a secretary of the Central Labor Union, first proposed the holiday.

Expand Your Business... Without a Test!

With football season about to start up, let’s talk stadium construction. Last Super Bowl we talked about what is the most expensive and likely the most technologically advanced stadium ever built, that being SoFi Stadium in Los Angeles, CA. So this time, let’s look at what is the second most expensive stadium ever built and quite a marvel unto itself, that being Allegiant Stadium in Las Vegas, NV which is scheduled to host the Super Bow this coming year.

The venue is located on about 62 acres of land  and the construction of the stadium began on November 13, 2017, and its certificate of occupancy was issued on July 31, 2020.

Allegiant Stadium is a 10-level domed stadium featuring an ETFE roof, silver and black exterior with light-up strips installed by YESCO, a 275-foot (84 m) media mesh video screen facing Interstate 15, and large retractable curtain-like side windows facing the Las Vegas Strip. The north endzone area in front of the retractable windows contains a large torch that houses a flame in honor of Al Davis, the late long-time owner of the Raiders. The torch is 85 feet (26 m) tall and is currently the largest 3D-printed object in the world.

The stadium has a roll-in natural Bermuda grass field similar to the one at State Farm Stadium in Glendale, Arizona, which is primarily used for NFL games. The main advantages of such a configuration is that it allows the natural playing surface to be exposed to natural sunlight when not in use and allows other events to be held at the facility without any risk of damage to the grass. Unlike the Arizona facility (which does not have a varsity tenant) Allegiant Stadium also has an artificial turf field, which is primarily used for college football games. This design was chosen because UNLV prefers to play on an artificial turf surface, and also due to concerns that use of the grass field by two teams would cause excessive wear to the playing surface. The artificial turf is placed directly on the stadium’s concrete floor, and the tray holding the grass field is designed so that it can roll in and out without disrupting the turf underneath it.

On September 18, construction activity began on the stadium site with site preparation. A groundbreaking ceremony was held on November 13. The ceremony featured NFL Commissioner Roger Goodell, Raiders owner Mark Davis, his mother Carol Davis, various Raiders legends along with various celebrities and local politicians. On August 27, Clark County gave the stadium a new address, rechristening it from its original 5617 Dean Martin Drive address to 3333 Al Davis Way.

The original budget for the construction of the stadium was $1.8 billion. The budget was increased twice in 2019, the final cost ended up at $2 billion. Of this $2 billion, $78 million was spent to purchase the land, $1.33 billion was spent on construction, $123 million on furniture, fixtures, and equipment, $234 million on design and engineering, and $31 million on utilities and infrastructure. Some reports gave a budget of $2 billion, which also included $100 million to build a separate Raiders practice facility

New California Construction

The Los Angeles County Museum of Art announced last week that the Building LACMA campaign has passed its fundraising goal of $750 million.

The campaign will fund construction of the David Geffen Galleries, the museum’s new home for its diverse, global, and historic collections, which is now more than 65 percent complete and spans Wilshire Boulevard.

The new building will be 347,500 sq. ft. and will replace about 393,000 sq. ft. of existing buildings. The project also includes:

  • 3.5 acres of new public outdoor space (2.5 acres in Hancock Park and 1 acre on the Spaulding lot).
  • 260 existing parking spaces on the Spaulding lot will be relocated to a new parking structure on Ogden Drive.
  • Seamless integration of the new building with the existing park and remaining LACMA buildings.
  • Replacement of inefficient, deteriorating buildings with new, environmentally sustainable structures, embracing state-of-the-art resource management and technology resulting in achieving LEED Gold certification.
  • West Campus facilities (BCAM, Resnick Pavilion, and Pritzker Parking Garage) and the Pavilion for Japanese Art will remain.

Scam Alert!

The CSLB has issued a scam alert, particularly related to solar installation.

Door-to-door scams are on the rise. Do not just give money to someone who knocks on your door. Unfortunately, in this day and age, you have to do your due diligence and make sure people are who they say they are with the skills they say they have.

There has been a rise lately of people knocking on doors, convincing the resident they can get solar for cheap and fast and then take the money and disappear or do sub-standard work and disappear. Always remember, if it sounds too good to be true, it is.

Fortunately, the CSLB has made it easy to check up on a license. If someone knocks on the door and it seems legit, get their license number, get their business card and research the company. Don’t fall for high-pressure tactics.

Start by using the link below to check the license number with the CSLB. If they don’t have a legitimate license, DO NOT work with them. If the license number checks out, look into the company. Make sure that they are insured. Find online reviews and see what others have said about them. It has never been easier to do your due diligence.

Again, NEVER just give money to someone knocking on your door.

Our Quarterly RMO Ambassador Luncheon

This past month we hosted our quarterly RMO Ambassador Luncheon. Once every quarter we like to get together with some of our local RMO Ambassadors, treat them to lunch, hear their stories and get their feedback on how we can better serve them. These lunches also provide our RMOs with networking opportunities to grow their own businesses and create new friendships with like-minded individuals. This time we all got together at Lucille’s Smokehouse. Great food with some great people! We love to connect with our RMO Agency family and it was wonderful to spend the afternoon together. Here are some pictures from the event. We were also able to talk to our RMOs on camera and you will be seeing some of the footage in the near future, so look out for it! Proposed Rule Changes From The CSLB

For some time now there has been a back-and-forth conversation about who is legally able to install  Battery energy storage systems;
C10 (electrical contractor) or C46 (solar contractor)

CSLB Resource

Existing law:
Existing law expressly authorizes the C-10 Electrical Contractor and the C-46 Solar Contractor classifications to install photovoltaic solar energy systems (PV systems), as follows:

  • An electrical contractor places, installs, erects or connects any electrical wires, fixtures, appliances, apparatus, raceways, conduits, solar photovoltaic cells or any part thereof, which generate, transmit, transform or utilize electrical energy in any form or for any purpose. (CCR, tit. 16, § 832.10.)
  • A solar contractor installs, modifies, maintains, and repairs thermal and photovoltaic solar energy systems. A licensee classified in this section shall not undertake or perform building or construction trades, crafts, or skills, except when required to install a thermal or photovoltaic solar energy system. (CCR, tit. 16, § 832.46.)

This proposal would:

  • Add a new definition of “battery energy storage system” to section 810, “Definitions,” of Article 1, Division 8, of Title 16.
  • Add “battery energy storage systems” to the description of the C-10 Electrical Contractor classification in section 832.10, “Class C-10 – Electrical Contractor,” of Article 3, Division 8, of Title 16. The proposal also replaces “solar photovoltaic cells” in section 832.10 with the more accurate “photovoltaic solar energy systems” from current section 832.46.
  • Revise the existing section 832.46, “Class C-46 – Solar Contractor,” of Article 3, Division 8, of Title 16, by adding two new paragraphs to establish, for the purposes of the C-46 classification, that: (1) a BESS, as defined, is not required to install a PV system and shall not be considered within the scope of the C-46 Solar Contractor classification except as specified in the next subdivision; and (2) the C-46 installation of a BESS is incidental and supplemental to the work of a C-46 Solar Contractor when the BESS is installed at the same time as PV system and the BESS rating does not exceed 80 kWh.

So it sounds like CSLB is proposing a change and a verbal clarification that allows the C10 to install BESS and allows C46 to install it only if incidental and supplemental to the work of the solar contractor and the BESS rating does not exceed 80 kWh.

CSLB Is Coming Down On Unlicensed Contractors

Just in the last month, the CSLB has had several major busts on unlicensed contractors and in the process arrested well over 100 suspects.

Do NOT let yourself be caught up in something like that. A bust like that on your record can not only destroy your professional career, but it can destroy your life as well.

A bust in Tahoe saw 7 suspects arrested for submitting bids for jobs they were not licensed to do. Read More HERE

A sting in Orange County saw 8 individuals arrested, not only for bidding on work they were not properly licensed for, but also for illegally advertising for that work. Remember as a business owner there are laws for how you advertise your business. Read More HERE

A sting in Rancho Cordova uncovered 10 individuals who were allegedly contracting without a license. During the operation, CSLB cited 10 individuals for allegedly conducting contracting activities without the required license. These offenders have been issued Notices to Appear in criminal court, where they could face legal consequences, including fines up to $15,000 and/or jail time. Engaging in contracting work without a contractor’s license is a misdemeanor offense in California. Read More HERE

CSLB’s Statewide Investigative Fraud Team (SWIFT) collaborated with the Sonoma County District Attorney’s Office on the sting operation. The alleged unlicensed contractors were invited to submit bids for various construction projects at a designated property. The sting operation resulted in eight individuals being given a notice to appear in criminal court. All may now face legal consequences, which can include substantial fines and potential jail time. Over three weeks, CSLB joined forces with local law enforcement to conduct undercover sting operations in Sonoma, Sacramento, Madera, and San Bernardino counties. The stings targeted unlicensed contractors, with investigators contacting the suspects through their advertisements. Now 90 alleged unlicensed contractors face legal action. Read More HERE

20 unlicensed contractors were cited in CSLB sting operations in Madera and San Bernardino Counties. The operations took place in late June and resulted in 20 individuals being served with Notices to Appear in criminal court for allegedly engaging in contracting activities without the required license. Managing Treated Wood Waste

Sacramento, CA – The Contractors State License Board has been advised of additional resources for contractors working with treated wood.

On behalf of the treated wood industry, the Western Wood Preservers Institute (WWPI) has geared outreach efforts toward California residents, businesses, contractors, landfills, transfer stations, and waste haulers who are involved in treated wood waste (TWW) disposal. AB 332, which passed in 2021, required the wood-preserving industry to work with state regulators to conduct educational outreach efforts on the handling and disposal requirements.

In spring 2022, WWPI launched the TWWDisposal.org website to provide key information on disposal, including links to landfills authorized to accept treated wood waste. Thousands have accessed the site to learn how to identify treated wood waste and understand the requirements for handling, storage, labeling, and transportation of treated wood waste. To enhance understanding of the regulations, the website is available in both English and Spanish-language versions. The website also includes guidance for contractors who may be generating or disposing of treated wood waste.

Since last year, the City of Sacramento now offers treated wood waste disposal through its Household Junk Pickup Program, becoming the first city in the state to do so. Additionally, the re:source website serving Alameda County, Contra Costa County, and the City of Palo Alto now provides disposal locations that accept treated wood waste.

CSLB is distributing this message pursuant to subdivision (e) of Health and Safety Code Section 25230.15. Please refer to the Department of Toxic Substances Control website for information on treated wood waste or to the Western Wood Preservers Institute for more information about this message or about treated wood waste in California.

Build Your Own Death Star

in honor of May 4th – Star Wars Day, we were wondering what it would take to build a Death Star. Who doesn’t want their own Death Star?!

Size estimates of the Death Star vary between 75 miles and 99.5 miles in diameter, that’s pretty big. So mostly, you’re gonna need money and lots of it. Estimates go up to $852 quadrillion, that 852 followed by 15 zeros.

This mega project would require a lot of steel. By some calculations, the Earth has enough iron in its core to provide for two million Death Stars. But you wouldn’t want to sacrifice our planet for an army of deadly weapons, would you? Even if you took only the amount of iron needed for one Death Star, it would take over 830,000 years to produce enough steel so you could begin construction. It would take millions of rocket launches to get the steel where it needed to go.

Then you gotta man the Death Star. Weapon or not, this space station would require 1.7 million staff to run the station’s retail shops and troop cafeterias.

Add 25,984 stormtroopers and 342,953 Imperial Navy soldiers, and you’ll get 2,068,937 people living aboard the Death Star. If each person on the Death Star created 1.13 kg (2.5 lb) of waste every day, it would cost $564,925 daily not to turn the Death Star into a landfill. That doesn’t include people who fell into a trash compactor and weren’t able to blast their way out.

The daily electricity bill would add up to $52 billion. $274,000 to feed the crew, with another $20,400 to supply tea or coffee. $233,000 for one cycle of laundry. You wouldn’t expect your troopers to run around in dirty underwear, right?

The total for keeping the Death Star operational would amount to $7.8 octillion — every day.

Repeat Unlicensed Contractor Sentenced to Seven Years in Prison

SACRAMENTO, CA – A Modesto man who was on the Contractors State License Board (CSLB) Most Wanted list has been sentenced to state prison again for charges related to unlicensed contracting.

A Contra Costa County judge sentenced 42-year-old Adan Contreras Rivas to seven years and eight months in state prison on March 10 after he was convicted in February of multiple felonies and misdemeanors related to unlicensed contracting, fraud,
theft, and failing to obtain workers’ compensation insurance.

The Contra Costa District Attorney’s Office filed an initial complaint against Rivas in March 2022 following an investigation into his actions that led to his eventual arrest. He was released on his own recognizance.

Rivas was invited to a sting CSLB conducted in October 2022 with the Contra Costa District Attorney’s Office and the California Department of Insurance targeting unlicensed contractors. He didn’t show up for his scheduled appointment but sent his parents instead to ask for a bid. This assisted investigators in contacting Rivas.

Rivas was arrested again in November 2022 for posing as a licensed contractor in the landscaping industry and stealing thousands of dollars from unsuspecting consumers.

New Revolution In The Construction Industry? Skyscrapers Made Of Wood

We found this to be an interesting story. Builders are increasingly turning away from concrete and steel in favor of wood. In some cases, the material – known as mass timber – is even being used to construct skyscrapers. It’s becoming a sort of revolution.
